Transit control requirements for military goods
The Export Control Department of the Ministry of Economy of Poland would like to inform that according to the Polish law (Law of 29 November 2000 on foreign trade in goods, technologies and services of strategic importance to the security of the Stale and to maintaining international peace and security), movement of goods listed in the export and transit list specifying military goods (Annex 1 to the Ordinance by the Minister of Economy of 13 November 2008 on the list of military goods) via territory of Poland requires transit license.
Only natural or legal person (Polish or foreign) that have:
- valid certificate of the internal system of control and management of trade related to items of strategic importance (Internal Compliance Program -ICP), fulfilling requirements of the given above Law;
- number of entry in the Polish Register of Entrepreneurs as defined in the National Court Register Act of 20 August 1997 (Journal of Laws of 2001 No 17 item 209, as amended;
- concession to carry out trade in explosives, weapons and ammunition, as well as products and technologies to be used for the military or police purposes, as defined in the Act of 22 June 2001 laying down the conditions of business activity related to production and trade in explosives, weapons and ammunition, as well as products and technologies to be used for the military or police purposes (Journal of Laws No 67, item 679, as amended);
is entitled to apply for authorization for foreign trade in items of strategic importance, including transit license.

We suggest using this list for selecting your business partner from among companies that specialize in forwarding and get in touch with him for further arrangements. Usually it takes about 2-3 weeks to get transit license after sending us by your Polish partner application that conforms to all the provisions of the mentioned Law.
