Ordinanceby the Minister of Economy and Labour 1)of 28 September 2004on the format of individual or global licences for trade in items of strategic importance and the format of import certificatesPursuant to Art. 9 (6) and Art. 22 (7) of the Act of 29 November 2000 on foreign trade in goods, technologies and services of strategic importance to the security of the State and to maintaining international peace and security (Journal of Laws No 119 item 1250, 2) it is hereby resolved as follows: § 1. 1. This Ordinance hereby sets forth the format of an application for individual or global licence for: 1) export of items of strategic importance, 2) brokering services, subject to provisions of section 2, 3) technical assistance, 4) import and transit of military goods - see Annex 1 hereto. 2. If brokering services consist in the transfer of items of strategic importance from one country to another, the application for an individual or global licence for the provision of services consisting in the movement of items shall be used, as set forth in Annex 2 (page 1, page 2) hereto. § 2. This Ordinance hereby sets forth the format of an individual or global licence for: 1) export of military goods or their spare parts ? see Annex 3 (page1, page 2, page 3, page 4, 2) import of military goods or their spare parts ? see Annex 4 (page 1, page 2, page 3) hereto; 3) transit of military goods or their spare parts ? see Annex 5 (page 1, page 2, page 3) hereto; 4) brokering services related to items of strategic importance ? see Annex 6 (page 1, page 2) hereto; 5) technical assistance related to items of strategic importance ? see Annex 7 (page 1, page 2) hereto. §3. This Ordinance hereby sets forth the format of an import certificate ? see Annex 8 hereto. § 4. This Ordinance shall come into force on the date of its publication 3) THE MINISTER OF ECONOMY AND LABOUR
1) The Minister of Economy and Labour manages the ?Economy? division of the governmental administration pursuant to § 1section 2 item 1 of the Ordinance by the Prime Minister of 11 June 2004 on the detailed scope of activity of the Minister of Economy and Labour (Journal of Laws No 134 item 1428). 2) Amendments to this Act were published in the Journal of Laws of 2001 No 154 item 1789, of 2002 No 41 item 365, No 74 item 676, and No 89 item 804, and of 2004 No 162 item 1695. 3) This Ordinance was preceded by the Ordinance by the Minister of Economy, Labour and Social Policy of 30 December 2003 on individual licences for trade in items of strategic importance and the format of import certificates (Journal of Laws of 2004 No 21 item 195), upheld pursuant to Art. 2 of the Act of 2 July 2004 amending the Act on foreign trade in goods, technologies and services of strategic importance to the security of the State and to maintaining international peace and security, amending certain acts (Journal of Laws No 162 item 1695). |
